My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.

My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?

How funny is this? My PERM was filed for Tech lead position and I am getting enquiries for PM position and I can not take it whereas you are trying togo in reverse direction. Anyways... you can not come in reverse direction now. The SOC code for Tech Lead is '"15-1031 Software Applications Engineer" which is definitely different than Computer Systems Manager and I believe logically management stream is altogether different than technical stream. Be very careful and refer to attorney at law before you make the decision.

We are looking to talk to a good immigration lawyer and seek opinions on the following
(1) H1b visa transfer process for physicians after residencies into a jobs
(2) How to handle licensing issues - murthy.com has some info, but we need a better perspective
(3) Green cards for physicians - eligibility and time frame and minimum requirements etc..
Any any other pitfalls or booby traps that one has to be careful about.
A lot of physicians do visit IV website - am wondering if there are any user groups or forums on web that discuss potential issues and other stuff that we discuss on IV.

I am on L1 visa since May 10, and have plans to switch to H1 without going back to India. My employer is not ready to provide experience and relieving letters, if I dont resign and I cant resign, since I need to pay 5000$.
1) So, does it make a problem while applying for GC, If I dont have these letters from present employer.
2) Inlcuding present company's experience only , I will be able to qualify for EB2 category. But I will not be having letters from my present employer to show that I am having 5 years experience.
Is it must to have experience and reliving letters from all my employers? What are the options for me now? :confused:

Hi,
I was on F1 visa and graduated with Masters degree in Electrical Engineering on Aug22,2008 and had applied for OPT with a start date of Aug25, 2008. But my OPT application was rejected on Sep26 as I had already filed for H1-b(in general quota) and my H1-b was starting from Oct1,2008.
Now I am on H1-b and intend to do an second masters degree. I know that OPT is given only once for one level of degree.
Will I be eligible to get OPT for my Second Masters Degree ?
Also I am on H1-b visa for 6 months now and intend to go to F1 starting August, 2009. Will I be eligible to file for H1-b after my second Masters Degree ?

Hi All,
I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.
Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?

Hello IV.org - I am on H1visa, which is valid until Sep 30th 2010 with stamping. To get eligible for a new 6year H1visa - Can I work for the same company but geographically located out side of USA for one complete year. [ Let's assume from Oct 1st 2010 to Sep 30th 2011]
Then apply for the new H1 from the same company in april 2012? OR can I apply in april 2011 and enter US at Oct 2011?

My I485 is pending. My co-workers' who applied the same time as me already got their green cards. I am planning to go back to my home country in Feb. What if my green card is approved while I am outside of US? In this case, can I still use my AP to come back?

Has anyone been in a situation where they joined a new employer after having completed 180 days after 485-filing, and sent in AC-21 documentation through an attorney?
If so, which attorney did you choose for the AC-21 paperwork?
- The old attorney, that represented you and your ex-employer, and filed your labor, 140, 485, EAD, AP
- or the attorney representing the new company
- or a third attorney that you went and found on your own
What do you think is the best way to go, if there is a best way to go?

My wife is on F1 and has applied for AP.
We have been waiting forever for AP(nothing new, right?).
Since her F1 is invalidated for the purpose of re-entry, can she apply for H4? and use that for re-entry?
If you have done this change to H4 recently, I will very much appreciate your reply.

yup. you should have completed 180 days I guess after getting 140 approved. There are many threads for this discussion. try to find it.
Its not for the I-140. If you have completed 180 days after applying I-485 & I-140 approved, you can use the AC21. But if you have only I-140, there is no use.
