I have a offer from an employer and they say that they will be able to provide documentation for GC processing but will not be able to sponsor. What does that mean? Can i hire attorney for my GC processing(EB2) and pay the expenses by myself? What else would be required from the employer?

My EAD is expiring in August 18 2010. How many months before should i need to reniew them. is it ok to apply just before 90 days?

Hi all.
I just came back from Canada after 4 days using 30 day rule as I wanted to recoup few days so that my co. can apply for 7th year extension because my LC shall be pending for more than 365 days. My question is does my employer have to file two seperate LCAs for each I-129 application or same LCA copy can be attached with each I-129 ( 1st I-129 for extension for 3 days, 2nd I-129 for 1 year extension ) ?
( NOTE- MY I-94 WAS EXPIRING ON 15TH MAY AND LABOR CERT. SHALL BE PENDING FOR MORE THAN 365 DAYS ON 17TH MAY, SO I HAD TO TRAVEL OUTSIDE USA TO RECOUP FEW DAYS)

during stage 3, they require a birth certificate. what if I dont have a birth certificate? do they accept an affidavit from my parents with a domicile cerrtificate or not? i dont even have a school leaving certificate. please give me advices.

Hi,
I was working for Company A with whom I've my H1 & I-94 valid until Aug 2010. But I was laid off from Company A in Dec 1st week and I found a new job with Company B in Jan 3rd week. So I was out of status for about 6 weeks time.
Now Company B don't wish to file a transfer but instead they are filing something called H1 "Loose Petition", obviously I'm not going to start work with Company B until this H1 gets approved and I travel out of US, get restamped based on my New H1 petition, come back to US and start work for Company B.
But my question is, while from today until this so called "Loose Petition" H1 is getting processed (since they applied premium it would take about 2-3 weeks) can I legally stay in US (in terms of I-94 I've my I-94 from Company A H1 which is valid until Aug 2010)?
My employer suggest that I stay here until H1 processing result comes out and then leave country get restamped. Please let me know if you have an Answer.

How do I find out who gave me the "RED" reputation, I am a harmless person not making any personal comments on anybody in this forum, wonder why someone gave the red to me . Your obligations to IRS does not interfere with your GC process. This is not a "work" that you are getting paid for, outside your LCA.
It is very common and people before you have faced it and people after you will face it. Calm down and take this one worry off your list.

Hi,
I have an F1 visa that expires on July 11'th 2009.
I am currently on OPT and working. My OPT lasts for another 10 months.
I have just got my H1B application approved in the latest round and am allowed to get it stamped only after October. Therefore between July 11'th (end of F1 visa) and October (stamping of H1), I will be in the US without a valid visa but with a valid OPT.
I need to go to India in June and return on July 10'th- 1 day before F1 visa expires. Am I allowed to re-enter the US with 1 day of visa validity? What documents do I need to carry with me? How should I show them that my H1B is approved and will be stamped in October?
Will they let me back into the country knowing that starting 1 day later I will be without a valid visa until I travel outside the country in October to get my H1B stamped?

I also understand and have developed AfterEffects peices for web publishing purposes. So if you need Flash animation, I can do that too. My lastest work was a FLV and Flash intro peice for Enyce.

If you're already eligible to use AC21, then I see no problem working as consultant as long as it is of the same job category as your LC. ATP and location does not matter anymore.
