Hello folks. I hope someone can help me out on this issue. I applied for my wife's EAD back in July 2007. The EAD was processed in two weeks and we received the card. However, my wife's middle initial was incorrect and we sent it back to USCIS with an explaination concerning the mistake. USCIS stated that it would take anywhere from 2 months to 6 months to process the correction. Last week I received a letter from USICS stating that I need to submit a completed I-90 form. A I-90 form is used to replace a green card. We just applied for our adjustment of status in 6/2007 and are not permanent residents at this point. Getting the EAD has become a nightmare for us. Do I try and write a letter back to USCIS stating that they are asking for the wrong form. I tried to call them but they said to respond to the letter sent. I'm stuck between a rock and a hard place. Any help/advice would be appreciated.

If you have a valid I-94 i.e. not expired, you can apply for another I-539 to F1 - make sure to make the application stronger than last time.
If your I-94 is applied, you have no choice but to leave the country and get F1 visa in your home country and come back.

Nina Bernstein, one of the country's best immigration reporters, has a front page story in this morning's Times regarding 30 survivors of the January Haiti earthquake who were airlifted by Marines to the United States and are now sitting in detentions centers in Florida. Nothing unusual...infact just a tiny tip of an iceberg. Family based immigration including marriage constitute close to 85-90% of US new immigrants. Other avenues being tightened in recent years, we are sure to see more and more. In fact in recent years I have seen many H1Bs/F1 marrying USC.
For every case being busted, there are many many undetected cases. It is called legal arbitrage, with other areas being tightened amd under attack and marriage based being relatively untouched, it is a matter of time that one will increase.

I just wanted to ask for your general advice. My H1B expires in July 2010 so I know I have to turn in my PERM application before then so I really have only about 2 months to start recruitment process. I also have a green card to Canada so I could go there but I do like my current job in the US and living in New York City is really great!
Anyway, my question is. How tough do you think it will be to start PERM process now in this current economic downturn and the fact that it is in New York (millions of people)? Do you also think there might be some legislation in a near future to make it more difficult for us to get green cards?
I understand you can't answer those questions exactly, but a piece of advice would be greatly appreciated. Thank you all!

I work for a non-profit State University (6+ years), and my supervisor is letting me work from Canada for a year or so. As my university HR needs to have an H1B permit to keep me on the payroll, my University's International Officer is willing to keep my permit valid and keep renewing it even beyond 6 years as my I-140 is approved. She says that I can also apply for an H1B visa in Canada and visit US whenever my supervisor asks me to do so.
Wondering if this is doable without violating the USCIS & LCA rules and regulations? Thanks.

My original birth certificate has all the details needed, except that my last name is an initial, and not spelt out completely. Would I require an affidavit with an expanded last name?

As Birth Certificate is part of Initial evidence, 2 secondary evidence affidavits for incomplete/incorrect entries is always good for peace of mind. Search for numerous threads on Birth Certificates last month for affidavit format, who can provide etc.

We have filed an I-130 for our dependant child of my husband who is currently an alien resident. We are trying to figure out how to get a work authorization form started for our son as well as he is old enough to work. We can not figure out how to answer his eligibility catagory. folks, with a lot of effort I got to know the case number of my AEC filed during mid 2001 ( P2002-XXXXX ) (EB3 RIR)
my company did not respond to the NOF due to lack of hiring and layoff's in the company... and then their policy is not to share the case number with the employee...
a standard answer that 'the application will be denied and has been denied' is being given by the HR.
what all can I try to get the status of this application... I have tried to email info@dallas BEC address and they wanted more info and currently awaiting their reply..
what would be the result of such an application? when NOF has not been responded to...
if a case has been denied..will there not be any paperwork from the SWA that it has been denied? or can this case get remanded and go as a TR case (non RIR)?
if anybody has faced something similar let me know... thanks!

I am currently working on H1B. My wife is currently in India with approved I797 for H1B (starting Oct 07). We are debating whether to get H1 or H4 stamped on passport. (H4 is totally our decision and for H1 we need to depend on her company's schedule).
- Can she come to the US on H4 (lets say next month) and if and when she finds a job (lets say next year), can she switch to H1? Is there a time limit before H1 will become invalid?
- If she comes to the US on H4, are there any issues changing status to H1?
- Are there issues when she goes to India again to get H1 stamped?
- Is there a difference between the I797 approval notice if a person is out of US vs. in US? (I have read something about I-94. I thought I-94 is always attached to 797 approval notice).
