yes. it can be done inside USA by filing I-539.
The school must first issue I-20. Then, you can file I-539 with the INS by attaching the I-20.
INS will approve it and return you I-20 along with a new I-94.

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!
I am so frustrated that I feel like going back to home country now.

They can pay you in anything they like for immigration purposes. US immigration doesn't care what you get paid when you're outside the US.

Hi all,
I am going to US this year December. I also took Tickets for my Travel with the same name as in Passport. And in my Passport, my Surname & Firstname are completely mensioned. But my name in all my certificates is in short form like ( S H V My Name). Will this cause any problem in future if I apply for H1B??

3 SR, 2 letters to Ombudsman, letters to 3 senators, letters to 2 representatives, 2 fax to NSC, 2 letters to NSC Director, 1 infopass, numerous calls to NSC
Recently sent a letter to first lady. Looks like all of them are working together. Nobody wanted to respond.
Please feel free to write your experience if you are 2002 filer.

I filed my I-485 in Aug�2007 and my I-140 is approved in EB2. My daughter was on dependent H-4 and her I-485 also was filed in Aug�07 as dependent on my GC. She completed 21 year in June�2008.
My question is if we receive our GC in current year, she will get GC as she already crossed 21 years? Appreciate your answer and thank you in advance.

This is related to the experience letter and PERM.
I have been working with my current employer for last 3 years in software engineering role. Now I'm planning to move to program management role and planning to apply PERM from this new role.
1. To get experience letter for PERM, can I use the experience gained in my current company. What are the chances of AUDIT if I do so?
2. With my previous employer (3 yrs back) I worked in software and consulting role. Does this experience suffice for my PERM in program management role...Is it something the lawyer has to worry and not me..

Since first day, if u have tried to make I485 filing w/o priority date current..
At least 90% of people wud have utilized AC21 and change employers.
Ofcourse you always convince the higher authorities, to let us file 485s and issue GC, when dates become current.
As long as we file 485 and utilize AC21, we will be in safe situation.
Have some plan and result oriented plan.
Thinking big is ok, but we shd know what actually we can do.

I am on L1B with I94 expiring on April 2012 from Company X, I found an employer Company Y who will file my H1B in June/July 2011 under premium processing. If H1B is approved then:
1. Can I work under Company X till Sep end and join Company Y from 1st Oct without any hassel?
2. Will my status will change automatically from L1 to H1 from Oct 1st onwards?
3. Will my new H1b will be valid until April 2012 only? as my current i94 (on L1B) is till April 2012?
4. I can travel to India and return in Sep 2011 using my existing L1B? Will there be any problem in port of entry? I have traveled using L1B to-from India multiple times, but I am concerned now because I will be having H1b approved along with L1B.
5. Is there anything special I have to ask the employer before filing H1b so I can go and return from India on my L1b status?
Will appreciate response.
