I don't know much about the process, I just came to America less than 1 year back, but I know my lawyer was supposed to mail application to reach on July 2, 2007 instead he made a mistake to reach on June 29, 2007 because he said July 1, 2007 was a Sunday so he would rather be early than late. USCIS accepted and receipted me.
I am the manager in my brother's gas station in LA. He got a investor visa when he came from Punjab but now he is citizen. I am on EB3. I have Bachelors in Business Administration from Panjab University in Chandigarh. I can't be EB1 or EB2, I barely made it through college :D

This is an excellent thread. It's something I've been looking for for a long time. I am still not clear about using AC21. Here's my situation.
July 2nd filer. Received EAD for me (primary) and my spouse. Waiting for I140 approval. I understand it's risky to invoke AC21 before I140 approval. After I get it approved, here's what I intend to do.
1. Inc a business in my spouse's name.
2. Invoke AC21 and join my spouse's company as a "Software Engineer" (my position in LCA)
If I do this, during I485 adjudication, all I need is an offer letter from my spouse company saying that I am working as a Software Engineer right?
Also, does USCIS care during I485 adjudication whether I got paid continously while employed with my spouse's company?
If for any reason, I decide to quit my spouse's company before I485 adjudication and move to a different company, Will I be able to do this?

please guys just write as many as you can...as i pm'ed pappu...my piece was touchy feely, because i wanted it that way. He suggested some additions to add contributions of immigrants/details of retrogression but I declined cos i felt the touchy feeliness (so to speak) would be diluted.

Came here in 98. Applied in 2003. Waiting ever since. Had enough of this BS. I was ok until they started screwing around with EAD's and AP's this year. Recently, got a a couple of offers in India ranging from 30 - 45 lac / yr. Thinking of going back. Its not worth waiting in this line anymore.

I have been on a monthly contributions program that contributes every month to IV since JAN 2007. If this effort requires the money now, is there a way I can divert the monthly to this effort for the next 3 months. Or should I cancel my monthly contribution and just donate a lump sum for this effort?

I don't think so. Eventhough they make U in september bulletin. They have to move dates in October bulletin because of new visa numbers.
I can understand the excitement. I am also in EB2 2005 PD. But the fact is that, this seems like a temporary movement only...i don't think dates can stay at 2006, going by simple math.
PPl can give me those red marks, but i think dates will retrogress again by Oct.

My H1 extension is under process. I had applied in Dec 2006. My DL expires on May 6. Is it possible to renew my license with the H1 extension receipt?. Is it possible to do Premium Processing now?
Not sure about NJ, but in NY they want to see your i94 that is attached to your approval notice if you dont have a valid stamp.
You do have time for premium processing but also find out locally if you can go back with an expired DL (expired within a month or so) , in most DMV I think they permit extension of expired DL. I am not sure about it, but You may want to verify.

Arrived to USA on October 1999 at H1B. Started the green card in 2000 under EB2 but due to dot com burst changed the Job. Started again GC under EB3 in 2002 but the attorney and the company took one year to file the paper to USCIS.

this is surprising. really the dates should move- at least some. i keep thinking with each bulletin that EB3 will surely move now but it just has not happened. at this moment of course they have simply made it U. i wonder though if the dates will move when the october quota comes in.

I have filed I-129 and I-539 at VSC (RD 7/16/07) and also concurrently file I-140 + 485 at NSC on 7/2/07 (No Checks cashed yet). My H1 and spouse's H4 expires on 9/30/07. And so does our DL.
I called the PA DoT and they said that they need the following documentation for the DL renewal:
H1B & H4 Visa
Passport
I-94
Visa
Proof of employment (For H1 only)
2 Proofs of residency (For H1 only)
Rejection letter from SS Office (for H4 only)
They will not accept a Receipt Notice. They also said that if the Visa wasn’t valid for more than a year, they will not renew DL. I don’t know if they will accept a Visa stamp on the passport or approval of I-129 & I-539 will suffice.
From your experience, at this time, if we apply for PP, will they process my spouse's application along with mine, so both approvals come around the same time? Please advise.

I am not giving any benefit of doubt rather expressing my view. No doubt this bill is ringing alarm bells , no matter whether its staffer etc its senators who are bringing on to it , i agree , but the key thing as carefully drafted poison is this draft it cant be achieved by senators in days of negotiations they claim, its been definately on these tables for even months before its publicised. By saying this , i am very much surprised when i went through all the text of it , its shameful on all these ppl for trying to sink ppl like us for vote bank politics. Atleast i thought they would do some good but its becoming more harm day by day.

Everything depends on how much resources we can put to bare and collectively make an effort. This means, contributions from everyone , Phonecalls to Senators tomorrow onwards from everyone , Webfaxes from everyone , emails to all senators (from all IV members) and of course get as many members as you can to join this effort. We need overwhelming participation from each and every member if we really want to accomplish something big for everyone that takes care of all our interests.

At least I know 3 or 4 universities in around MI and OH. They have only online classes and on Sunday. It allows most of the students to take their classes that way. The rest 6 days they can work any where and make money and pay the university. One of the universities has 90% of the students from one of the small countries adjacent to India.

PersonA = PD of May 30th, 2003 and RD of June 15th, 2007.
Assume that an additional 150,000 I-485 applications were filed petween PersonA and PersonB
PersonB = PD of May 15, 2002 and RD of July 15th 2007.
USCIS starts pre-adjudicating cases based on Receipt date. Assume that by October 1, 2007, they have pre-adjudicated PersonA plus 9,000 of the 150,000 applications and haven't reached PersonB's application yet (they go by RD).
Assuming that the visa cutoff date in Oct, 2007 bulletin is June, 2003 making both PersonA and personB current:
PersonA (PD of 2003) will get a visa number and get the case approved while PersonB (PD of 2002) with an older priority date will have to wait a while because his case hasn't been touched by USCIS yet due to the additional 150,000 filings in between that have to be pre-adjudicated first based on RD even if they have 2004/2005/2006/2007 priority dates!!
