Hello Guys
I recently received an RFE - I 140 and USCIS is asking for all the W-2's from 2004 - till date as i came to U.S.A in November 2004. I got my SSN in Jan ' 2005 and i have all the W-2's from 2005. I am currently unable to understand what to do in this situation. Did anyone had the same problem like me. Please shed your thoughts on this. :confused: :mad:

My spouse is out of country and she cannot comeback immediately since we are waiting for my H1 extension approval. Taking visa appointment days and airline availability in to consideration, she may not be able to make it back before end of july. I heard you can always add spouse later while 485 is still in progress. What are the implications if I go this path ?

Very recently our company advertised for a position, this was for one of my co workers from China, company received over 200 resumes, I heard that the new rule is to reply to all the resumes and tell them why they dont qualify etc..

is this true. My mother came back last year using AP but she never got a new I-94. He AP was stamped and the validity of her stay here. So not sure if you will get a I94 or not. please eloborate.

I am a July 19th filer and I have not received my receipts. I checked with my lawyer yesterday and they have not received either. Since my lawyer issued all the checks I have no idea whether my checks are cleared or not. So here is my question. How long will it take for the actual reciept after the check clearance.

We filed our 485s during the July 2007 fiasco. We moved after an year, so we updated USCIS with our new address by filling AR11 online for all the petitions(485s, 140)
My 485 status is in pending state but by husband's petition has a status of "Notice Returned as Undeliverable". Now it is more than 6 months since that update. Do I have to follow up on it? Any input appreciated. Thanks much in advance.

I need some clarity on this issue. I know AC21 helps switching jobs within the same field/duties, but here is my line of thought... I'm past 2yrs on my H1 and I plan to do a part-time MBA (~3yrs) after which I'd like to be open on the kind of job I do.
Now, my questions are: (1) Does switching to EAD really pause the H1 clock?
(2) Is that triggered by filling a new I-9 form alone, or by entering the US on AP, or both?
(3) I guess, I should be able to apply for a fresh H1 with a new company and switch back from the EAD to new H1, right?
I know I'll lose the GC priority, especially wife's EAD, but I'm debating if it's worth losing my career aspirations? My info: Nov '06 EB2 PD, approved I-140, July 3 I-485 receipt and my present company will file our EAD/APs as long as it is necessary.

Hello Members,
I noticed that the dates on my i-765, i-131 and i-485 changed to 9/1/2008 today. This has not changed since I got my EAD. None of my wife's dates have changed. Does this mean anything? The things I have done lately that might (or might not) have caused this:
- Called CSR to check on status. She asked me to call back as my processing dates are not current yet.
- my lawyer sent G-28 so they could check on any information for me.
Here is some info:
i-140: 9/26/2005
i-485: 7/23/2007

Guys I will be going for my first H1 visa stamping in New Delhi. I am currently in the US. I transfered from F1 to H1. Have been looking into documents to take to the interview, and looking at so many 221(g) cases, have been confused by this term "unemployment wage report". I would really appreciate it very much if someone could please tell me what is "unemployment wage report" and how is different then "prevailing wage report"? Also, do I need to take both of them to the visa interview? Thanks!

What a piece of work from the man who warned us about death panels in the health care bill. His grasp of the facts don't seem to be much better when it comes to USCIS' enforcement of H-1B rules. From this letter, you would think USCIS is sitting around eating bon bons and not engaged in one of the most serious crackdowns in the H-1B program in decades. I heard that there was a deadline to send 45 day letter before end of June this year. And I have seen 45 day letters coming to my friends and me.
Question is: Is there any deadline for them to complete processing all cases???
Another concern. When they are done processing all 350K cases, think of retrogression!

The U.S. Department of State (DOS) reports that no later than April 30, 2010, all non-immigrant visa applicants worldwide will be required to use web-based form DS-160. The DS-160 form will combine the previous forms DS-156 and DS-157 and 158. Since not all U.S. Embassy’s and U.S. Consulates have implemented form DS-160, all consular posts that are not currently utilizing the DS-160 Web-based form will eventually be instructed to implement the DS-160 between March 1, and April 30, 2010.
