gctest, personally I don't see any issue with eb3 to eb2 porting, look at the porting opportunity from eb3 applicant's point of view, these applicants are waiting since 2001 for GCs but EB2 applicant with PDs 2005 are getting GCs, eb3 to eb2 porting is a way for them to jump ahead of 2006 eb2 filers and get their GCs, I don't see anything wrong with it, sure it causes 2003/04 eb2 filers (very few I guess) to wait a little longer but every law has a loophole and we just have to live with it,
How many eb2 filers are really qualified for eb2 labors? I see lot of consulting firms abusing eb2 labors and lot of people who are playing the game fair are left behind, I feel porting labor is a way to level the playing field, also people who filed eb3 labors in 2001, 2002 are qualified for 2005 eb2 labor anyway, just think these applicants file eb2 labor in 2005, as you said if they are not eligible they will be denied to use the opportunity and its OK if you wait a little longer

As EB1 is Cureent, presume processing applications up date, EB3 is Unavailable, means no work to do for USCIS people as far as EB3 Adjudicate cases, leave EB4, EB5 categories aside which dont have many applications to process. Then the only category left for working with is EB2 and that also having ROW being current, the adjuticate applications left for processing with available visa numbers are EB2 India for time being. So this means for the next few months including this June 2008 there might be many approvals in
EB2 India category, as because theres no considerable work in EB category for USCIS people except EB2 India Adjudication. So presumably all the available visa numbers will be processed effectively in the EB2 category for the fical year.

@OP, Yes. You can open LLC and/or S-Corp on EAD. If you plan on working for the same company, I suggest you do it in the name of your significant other if you are (un)lucky like me and married. Also checkout the option of "LLC filing taxes as a S-Corp". Here is link to more details from IRS.

The amendments were on the senate side and the HR bills are from the house side. Please contact your state chapter lead (walking_dude for MI) for updates and find out what's happening. We have lot of work to do and we really need volunteers. I am unable to post any info. on this public forum which is open to the world.

Just to let u know, during my H1 processing, my H1 was thrown back to my lawyer asking them to send photographs of my workplace and co-workers, server room, my desk. I had to use an entire disposable camera for the same. To make things even funnier, i was not even the First one to be on H1 in my company. We had atleast 7-8 H1's at one point in time. The reason given for a throw back was, that this company seems quite new and small.
I know this is off topic, but since someone has raised this point albeit in jest, i thought i should let people on here know that UCSIS has it's own whims and fancies at times. So if something similar has happened to you in the past know that you may not be alone. :)

Even large companies start as small and such small companies need high skilled US educated immigrants to innovate and grow the business. This is a problem not just with H1B applications but with green card applications. I am sure other people would have faced this situation when they filed their GC application through a small company with low annual income.

I have recently tried to explain them the EAD/485-pending concept and failed.
At the end, they waived their commission of 1%, so that I don't have to pay that amount.
The bank is GMAC.

it's clear our funds are not exactly astronomical.
so let's concentrate on building them up first along with our membership.
then we can sit back and worry about how much more is really needed....
For instance, I am sure maintaining this web site must cost money. How much more money is needed for our main cost drivers until March (for instance) --- by which time we are hoping some action will be taken?
Adding more members will always help because it produces a bigger impact on senators/ house reps
it's clear our funds are not exactly astronomical.
so let's concentrate on building them up first along with our membership.

Beware of HR 5924, this bill is planning to set aside 20k EB3 visa's for nurses instead of the current 10K. If EB3 folks loose focus and fail to push for recapture bill and somehow HR 5924 is passed. EB3 will be doomed.
Getting HR 5882 / S 3414 (recapture bills) through congress is the only hope for EB3's.
Changing the spillover will not help EBI because in both the spillover interpretations EB3I is the last in the chain. The only reason EB3I benefited from earlier spillover interpretations was because there weren't any ripe EB2-I cases available and it spilled over to EB3I. Reverting to the old spillover interpretation will not benefit EBI but sure it will benefit EB3-ROW.
Let us focus on getting the recapture bills through. Call u'r congressman/senator and start pushing for the recapture bill. EB3I has been benefited until now because of the AC21 recapture. Now it is time for another recapture.
