I worked for a MNC here in first few yrs at US (from 2000) and they suck up your Tax return , used to give a worthless health insurance and 'sweat shop' ( this probably a worse word than 'chop shop') like allowance for 12-14 hrs of work . If you do NOT accept that or ASK QUESTION your flight tickets back to origin to will be arranged. I know these practices changed to some extent over a period of time but by that time I left them and started doing things on my own ... :) and i'm very happy since then.
Another thing , I worked for good but medium sized consulting firms with US after leaving those shops ( sweat/chop/body whatever kind u call them) and they do maintain perfect balance - hardly 30-40% is H1B - they pay market salary to the H1B's ,standard health insurance , always got paid if i worked beyond 8-9 hrs ...

Not true. Whatever they can outsource, its already gone. There are certain position where the clients demand onsite resource. I am not supporting this bill in anyway, I hate infy as much as I hate this bill. Remember these companies did not leave any stone unturned, milked the client every possible way and expoilted the employees to the maximum extent. In one another post - VLDRao was saying these companies does the tax filing on behalf the emoloyee, get the refund and again claim that tax in india using double taxation aoivdance treaty.

Not to put any dampers here, but this is extremely frustrating for the EB3 India folks. I mean how freakin long do WE have to wait before we get our turn!
I am EB3-India with PD of August 2003. I am anticipating at least another 2 years. Any forward movement in any category is good news to me.

I gave my opinion on this in past. As we are dealing "very intelligent" community, need straight forward agenda to collect donation. Vague ideas don't work for collecting donation in our community. Pappu took a nice initiative and published 5 high level agenda items. Lets analyze how much money each agenda will need and we can move forward from there.

Is your case at NSC? I have definitely noticed a pattern of pre-adjudcation activity from NSC for cases filed in July-August 2007.

Hi,
Does anyone has recently got I-485 approval after porting priority date from earliar EB3 filing.
My I-140 got approved 2 weeks back and based on priority date, I am current. Ny EB3 485 was filed in July 2007.
How long it is taking for I485 to get approved after I-140 approval when the priority date is current.

I have filed EB2 & EB3 with the same company (As explained earlier). EB3 as Programmer Analyst and EB2 as Database Adminstrator ( MS + 2 yrs exp.). I think it is better to take some expert attorney advice on your case. It does not hurt if you consult ( or crosscheck ) with some other attorney about your case. Most of the legal experts charge around $250 to evaluate your case and suggest.

Can all of us at least send a joint request/letter to Rep Lofgren to ask USCIS to formalise a procedure for re-capture of visa numbers?I guess USCIS can do this without any senate approvals.At least ,this will decrease retrogression a little.Any major reform looks unlikely anyways till year 2009...

This retrogression and slow forward movement was a problem in the making. Last summer IV core had warned about this issue. The writing on this issue was on the wall, now we have numbers to prove it. Last year (2008) we ducked the issue because EB folks got lucky since almost 23K visa wasted by FB folks in 2007 was counted as part of EB limit in 2008. This year no such luck, we are stuck with our usual quota's. Refresh your memory with an old thread from last summer. (http://immigrationvoice.org/forum/showthread.php?t=19042)
Folks don't narrow this issue to an Indian/chinese issue. All EB3 folks and EB2 (reto countries) are affected by the retrogression. When the system is broken blame the system and not the individual department. Looks like members like to take a dig at USCIS for every problem in the system. Go talk to your lawmakers if you have issues with the system, they are the one who drafted the limits. Your labor was delayed not because of USCIS but by DOL. Yes USCIS is not a perfect org but they do their best. USCIS wasn't equipped to handle millions of EAD/AP every year aren't they issuing they issuing it within reasonable time. Give some respect to the org and just don't use it as a punch bag for all your problems. If you have issues with wastage of visa's go ask the lawmakers who introduced the 245i provision in 2000. They showed the EB folks with ~130K recapture and flooded the system with 245i applicants and caused ~130K visa numbers wasted between 2000-present. What was the net gain? We should collective organize and do active lobbying with IV, otherwise we will be taken for another ride in CIR.

You can check status of your case on line:

It will show you "Last Updated Date". Soft LUD means status of case is not changed but they updated LUD, virtually means they touched your file.

Has anyone done refinance from BOA on EAD / AOS (expired H1B & I-94)?
My current home loan is with BOA & I am trying to refinance with them, but they say we can't approve now because of status. I locked in rate in Sept. 2010 & now I am stuck as rates have gone up. After 4 months they have denied.
I don't know how to proceed further. They are not ready to give any letter & the lending policy. Any suggestions please......
I got my loan financed from BOA. I was putting 25% down on 550K home. They did not ask me even a single proof of my status before approving the loan . I am on EAD. Just a thought. May be you can increase the amount you are putting out of your pocket and may be they will approve. Again, just check this with them
